1. Our Copyright Policy
yOcala! respects the intellectual property rights of others and expects users of our platform to do the same. We comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and respond promptly to valid notices of alleged copyright infringement.
yOcala! has adopted a repeat infringer policy. In accordance with the DMCA, the accounts of users who are determined to be repeat infringers of third-party copyrights will be terminated.
Note: Section 230 of the Communications Decency Act (47 U.S.C. § 230) does not limit copyright liability. This DMCA policy governs all copyright-related matters on the platform, and we will process valid DMCA takedown notices as described in this policy.
2. How to Submit a DMCA Takedown Notice
If you are a copyright owner or authorized agent and believe that content posted on yOcala! infringes your copyright, you may submit a DMCA takedown notice. To be effective under the DMCA, your written notice must include all of the following six elements required by 17 U.S.C. § 512(c)(3):
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- Identification of the copyrighted work (or works) claimed to have been infringed. If multiple works are covered by a single notification, a representative list of such works is sufficient.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the platform (such as the URL of the specific page containing the infringing content).
- Information reasonably sufficient to permit us to contact you, the complaining party, such as your name, address, telephone number, and email address.
- A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.

Warning: Misrepresenting that content is infringing may expose you to liability under 17 U.S.C. § 512(f), including damages, attorney's fees, and costs. If you are not sure whether content infringes your copyright, consult a qualified attorney before submitting a notice.
3. Our Response Process
Upon receipt of a valid DMCA takedown notice, we will:
- Promptly remove or disable access to the allegedly infringing content.
- Notify the user who posted the content that it has been removed as a result of a DMCA takedown notice.
- Provide the affected user with a copy of the takedown notice (which may include your contact information), and inform them of their right to submit a counter-notice.
- Document the takedown as part of our repeat infringer policy.
We aim to process valid DMCA notices within 10 business days of receipt, though we will act sooner in cases where we can quickly verify the claim.
4. Counter-Notice Procedure
If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g)(3). To be effective, your counter-notice must include the following four elements:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled (e.g., the URL).
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original notification or an agent of such person.
Submit your counter-notice by email to admin@yocala.com with the subject line "DMCA Counter-Notice".
If we receive a valid counter-notice, we will forward it to the original complainant and may restore the content after 10 to 14 business days unless the complainant notifies us that they have filed an action seeking a court order against the alleged infringer.
5. Repeat Infringer Policy
yOcala! has a policy of terminating, in appropriate circumstances, the accounts of users who repeatedly infringe the copyrights of others. We track DMCA takedown notices associated with each user account. Users whose accounts are associated with multiple substantiated infringement claims will have their accounts permanently terminated.
The specific number of notices that will trigger account termination may vary based on the circumstances, including the nature of the infringement and whether the user has received prior warnings.
